I suggest that everyone at least scan this article to get some basics down and possibly even download it and keep it for future reference. Mold is one of the most prevalent problems in buildings in BC because we are exposed almost constantly to moisture here on the "Wet Coast".

So I am going to conduct a series of real estate information sessions based on the various articles I write for HOBN, Rapid Time News and Business in Vancouver. I have also found that when I do a session on one topic people invariably come with other real estate-related questions they want answered. However they don't feel comfortable bringing them up because "tonight's not on that topic". So I am planning a series of seminars/info sessions that people can show up at and ask basically anything they wish - assessments vs. market prices, buying into a strata (especially in light of the new strata rules), contracts, inspections, preparing a property for sale etc. etc. etc. I have two questions: A) do you think there is a market for this kind of "open session" real estate seminar and B) are there any real estate-related professionals who would like to participate with me in these sessions?

I do presentations on a regular basis and I think the open format is a good idea - but maybe it should have a theme or key topic that may resonate with people and then the rest of the information can flow from open discussions. You know I am interested in opportunities to meet and share information and ideas with people. Principal Residence, Investments and Trusts
The objective of this article is to help you minimize or avoid BC Probate Fee exposure to property including a principal residence.
Briefly, when a taxpayer dies, the estate property is probated in order to transfer title to the beneficiaries. Currently, BC imposes a Probate Fee of 1.4% on the fair market value of an estate that exceeds $50,000. For example, if your home is worth $3,000,000, the estate probate fee could exceed $41,000.
A unique tax benefit is available only to those who are age 65 or older. Trusts have been long thought of as tax planning for only the rich, and it has been common practice to roll or transfer an investment portfolio into a trust. With the recently increasing property values, more Canadians are able to utilize and reap the benefits of Alter Ego and Joint Spousal/Partner Trusts (Trusts). Property, such as a principal residence, included in a Trust does not form part of the estate property and is exempt from the probate process and probate fee, simplifying the transfer of property to beneficiaries.
A key feature of these Trusts is that the settlor (property owner) remains the income and capital beneficiary of the Trust during their lifetime. The features and benefits of these Trusts are similar, in that a principal residence is an eligible property, with specific provisions in the Income Tax Act which permits the exemption of capital gains taxation when the principal residence is transferred to a Trust, and later disposed of by the Trust (with the customary duly completed election form).
A further consideration is the BC Property Transfer Tax (PTT) and careful planning will provide for PTT exemptions on transfers to properly structured Trusts.
These Trusts have a wide variety of other benefits such as confidentiality, control of capital, incapacity planning, along with waiver of the 21 year deemed disposition taxation rule.
While these Trusts are very beneficial for taxpayers, proper structuring of one’s affairs is required in order to become tax efficient. Due to the technical nature of Trusts, consult a professional for advice.

In addition, any surplus cash left after all the fees and taxes are paid will also go directly to your beneficiaries.

Each year homeowners across Canada get an Assessment Notice in the mail telling them what their property has been valued at by the municipality they live in – and a tax bill based on that value. That is how municipal governments pay for the services they provide to us (…I know; it’s a debatable point..!). Many are amazed, some are shocked and others are scared - all for different reasons. Assessments are based on all the things that a realtor or an appraiser would consider – size of home and lot, age, condition, improvements, neighbourhood, local amenities etc. etc. If your property has gone down in value you may be concerned because you were hoping to sell it shortly. If it went up and you’d planned to stay in it, you may be concerned that your property taxes may go up. Whatever the reaction, what exactly are you reacting to? (…and don’t worry too much; if all local properties have gone up by roughly what yours has, your tax bill won’t change too drastically…)
Assessed Values are a valuation of your property by City assessors at a specific point in time (usually July 1 of the year previous to the year the valuation is for). So the assessed values homeowners are receiving now were performed as of July 1, 2011. In a market like Vancouver, where property values have been steadily rising each year, municipal assessed values have basically “followed” the market up each year. But in the Vancouver market the normally steady up tick in real estate values has recently experienced a bit if a hiatus. That “rest” began to develop around May/June of 2011, so just before the current municipal assessments were carried out for 2012. We have now had approximately 6 -8 months of prices here at least leveling, and in many sectors dropping. The result is that many of the assessed values that people are seeing now are actually higher than the true market value of the property (i.e. what a buyer would be willing to pay for it). Over the last decade, except for the bad economic dip in 2008/09, assessed values in Vancouver have followed market prices from year to year and lagged them by anywhere from 15-25%. That of course is a very rough overall estimate. There are many anomalies associated with individual properties for various reasons. But suffice to say that in general, as of early 2012, municipal assessed values have pretty well caught up with the real estate marketplace and in some cases surpassed it. So if you are selling your property and your realtor values it at or lower than the 2012 Assessed Value, he’s probably not crazy or lowballing you to get a quick sale. He’s more than likely correct (as long as he can justify it).
So what do you do if you are not happy with your assessment? You can appeal it to your municipality. Go to www.bcassessment.bc.ca and click on E-VALUE BC! Up until the end of March you can access not only your own assessment information but that of all your neighbours as well (great for nosey people...). But if you are planning on appealing your valuation, be careful! Once you open up your valuation with your municipality, they can raise their current assessed value as well as lower it!! The rule of thumb is that if you go up and down your street and see that your neighbours’ properties (which we’ll assume are reasonably similar to yours – the value is mainly in the land…) are mostly assessed higher than yours – let sleeping dogs lie!! You are probably getting off lightly.

Reputable debt counselling companies such as 4Pillars can often substantially reduce the amount of principal and interest that individuals have to repay to creditors, putting the debtor back in a liquid position much faster. If you know of anyone who might require this sort of service I would be happy to refer them to 4Pillars and if neccesary work with them on the RE side to help them get back on their financial feet faster. Not always do debtors have to sell their real estate holdings to get out of debt. But sometimes downsizing or outright selling can get things done in an easier and faster way as it frees up cash quickly. I'm happy to offer my thoughts and advice to people in this situation and also involve 4Pillars to the extent necessary...1 month ago

First I'd like to thank super-pro meeting host Marilyn Anderson for filling in at Yaletown today for my wonderful co-host Monika Becker. For those of you who don't know, Monika unexpectedly lost her father (who lives in Germany) over Christmas, probably the very worst time of the year for something like that to happen. She immediately left for Europe and didn't even know on the flight over if she would see him to say a final farewell. Sadly, he was gone by the time she arrived.
Marilyn and I are asking anyone who reads this post to add your thoughts of warmth and friendship here for Monika so she can read them when she arrives back here in Vancouver next week. Monika is a wonderful, warm, giving individual who also makes a big difference in other people's lives, both personally and through her Clear Directions Life Coaching business. Everything she does comes directly from her heart, so we'd like to make sure that she receives some of that warmth, care and giving back.
